SEOHUB, LLC doing business by operating a website TREATABLE.ORG, and employing Licensors, suppliers and third parties (hereinafter “TREATABLE”) reserves the right to change these Terms of Use (sometimes referred to as “Agreement”) and your continued use of this site constitutes your agreement to changes to these Terms of Use as they are made.

ADULT USE ONLY

TREATABLE is for adult use only. If you are a minor, under the age of 18 years, you should leave this site immediately and not use TREATABLE. If you are the parent or guardian of a minor whom you believe may have used TREATABLE, please contact us at support@Treatable.org.

YOU SHOULD READ AND AGREE TO THESE TERMS BEFORE USING THIS WEBSITE

Your use of this site constitutes your agreement to these Terms of Use (hereinafter “Terms of Use” or “terms”). You should read all of these Terms of Use prior to using this site. If you do not agree to these Terms of Use you should leave TREATABLE immediately and you should not use TREATABLE. By clicking the “I Agree” button, or taking any other action to indicate your agreement with these terms, you agree that you have read, accepted and agree to be bound by these terms. If a person clicks the “I Agree” button in order to utilize TREATABLE.ORG on behalf of someone else, the person clicking the “I Agree” button represents that they have notified you (the person for whom they are acting) about these terms prior to agreeing to these terms on your behalf and that you have granted them the authority and agency to do so on your behalf, and you agree that such person is your agent and you authorized them to agree to these terms on your behalf.

YOUR AGREEMENT TO FUTURE CHANGES TO THESE TERMS OF SERVICE

You agree to review these Terms of Service each and every time you use TREATABLE. From time to time you may be notified that TREATABLE has changed these Terms of Service. Any change to these Terms of Service are effective upon posting to TREATABLE. If you do not agree to any future change to these terms, your sole remedy is to cease using TREATABLE. Your continued use of TREATABLE after any change to these terms constitutes your agreement to the new Terms of Service.

TREATABLE DOES NOT PROVIDE MEDICAL ADVICE.

TREATABLE provides content in the form of text and images that are offered for informational purposes only. You agree that you will not rely upon the content of TREATABLE as, or in place of, professional medical advice for diagnosis and/or treatment of any symptom or medical condition you may have. TREATABLE encourages you to seek the advice of a qualified medical professional for the diagnosis and treatment of any symptom or medical condition you may have. You should not ignore, delay or not follow the advice of any medical professional with whom you have consulted because of any of the content on TREATABLE. If you are experiencing distressing and/or life threatening symptoms, such as you are having trouble breathing, or you are experiencing a loss of consciousness, or you are experiencing chest pain, or any other life threatening or distressing symptom, you should immediately call 911 and/or seek emergency medical assistance. You agree that any action you take, or do not take, after reading content on TREATABLE is taken at your own risk. Content on TREATABLE may include suggestions for over the counter health products, other products, laboratory tests, other tests, physicians, medical procedures and other procedures; inclusion in content is not an endorsement of such products, tests, physicians or procedures.

OUR RELATIONSHIP

TREATABLE is a platform that provides non-medical services to you and third party medical care providers, labs, pharmacies and vendors. TREATABLE does not provide medical care, but facilitates the provision of medical care between patients and third party medical care providers, labs, pharmacies and vendors. You agree that TREATABLE is not providing you medical care and that no doctor patient relationship exists or will exist between you and TREATABLE.

TREATABLE will facilitate medical care between you and a medical provider. You agree that the medical providers will communicate with you, and you with the medical providers, through the TREATABLE platform and that TREATABLE is not responsible for the security or privacy of the providers of communication services that you use, or that the medical provider uses. You agree that you are responsible for communicating with the medical provider and responding to communications from the medical provider and that you will not hold TREATABLE liable, or make any claims against TREATABLE as a result of your failure to respond to communications from the medical provider, your failure to communicate with the medical provider or your failure to comply with the recommendations of the medical provider.

You agree that your use of the TREATABLE platform does not establish a doctor-patient relationship between you and TREATABLE. You are, by using the TREATABLE platform, creating a direct customer relationship that TREATABLE will sell you non-medical services and/or non-prescription products. In creating this direct customer relationship you may disclose to TREATABLE personal health or other information. This personal health or other information is subject to use by us in accordance with our Privacy Policy stated below.

You agree that it is the sole responsibility of any medical care provider to direct your medical care. You agree that TREATABLE has no influence over, or responsibility for, your medical care or treatment. You agree that you will exercise due diligence to independently investigate each and every TREATABLE facilitated medical care provider to ensure you are satisfied with that medical care provider’s license, qualifications and competence to provide your medical care. By using TREATABLE to provide non-medical services to facilitate your medical care by medical care providers, you agree that you are satisfied with the license, qualifications or competence of the medical care provider(s) TREATABLE has facilitated to provide your medical care. In the event you become dissatisfied with the license, qualifications or competence of the medical care provided by any TREATABLE facilitated provider you should notify TREATABLE immediately at support@Treatable.org.

FINANCIAL RESPONSIBILITY

TREATABLE provides non-medical services and products and facilitates your care with medical providers, labs, pharmacies and vendors on a cash/credit card payment only basis. You agree that you are solely personally responsible for payment of the non-medical services and products purchased by you through the TREATABLE platform and you are personally responsible for payment of the TREATABLE facilitated medical providers, labs, pharmacies and vendors. TREATABLE does not participate in any federal healthcare programs such as Medicare and Medicaid. TREATABLE does not participate in any state healthcare programs. TREATABLE does not participate in any health insurance programs. You may on your own submit claims for reimbursement to any healthcare program for which you are eligible, however you understand and agree that TREATABLE does not and will not submit claims on your behalf.

TREATABLE LIMITATIONS

The TREATABLE platform and services are only available to adults, 18 years of age or older, who accept these Terms of Service and reside in states that we offer our platform and services. While the facilitation of medical care through TREATABLE provides great convenience, in some cases, in-person appointments with medical providers is required for you to obtain appropriate care. In the event an in-person appointment is required for your medical care, TREATABLE cannot facilitate such in-person appointment medical care at this time.

CONSENT TO TELEHEALTH

Treatable provides non-medical services and facilitates consultations with medical providers through what is commonly referred to as Telehealth. Telehealth uses the internet and technology to provide remote medical consultations where you are not in the same physical location as the medical provider. Telehealth has the advantage of convenience but also has disadvantages. The obvious disadvantage is that the medical provider cannot physically examine you, this may be a limitation that makes TREATABLE inappropriate to facilitate consultations with medical providers for your care. Prior to a TREATABLE facilitated medical provider consultation, you will be asked to consent to Telehealth care. You agree that TREATABLE is a third party beneficiary of that Telehealth consent.

PRIVACY POLICY FOR INFORMATION YOU SHARE WITH TREATABLE

When you use the TREATABLE platform, you will share your name, residence address, email address and other general information about you. That information is private and TREATABLE will only share it as necessary to provide you with non-medical services and facilitate consultations with medical providers. You may also share more personal information that is considered personal or protected health information pursuant to the Health Insurance Portability Act of 1996 commonly referred to as HIPAA. We will share that more personal protected health information to facilitate your consultation with medical providers, labs, pharmacies and vendors. Though TREATABLE is not a covered entity under HIPAA, to the extent required by HIPAA, federal and state law, other than sharing your general information and your more personal protected health information as necessary to facilitate your care, your information will be kept confidential and private and only disclosed as required or permitted under applicable federal and state laws.

Third Party Pixels and Cookies

When you visit our website, log in, register or open an email, cookies, ad beacons, and similar technologies may be used by our online data partners or vendors to associate these activities with information they or others have about you, including your email address. We (or service providers on our behalf) may then send communications and marketing to these email addresses. You may opt out of receiving this advertising by visiting https://app.retention.com/optout.

ACCOUNT SECURITY AND ACCURACY

If you accept these Terms of Use, in order to use TREATABLE you will create an account, username and password to access the TREATABLE platform for you and you only. You agree that the personal information you provide is accurate and reflects your true identity and residence. You agree that you will not permit anyone else to create a TREATABLE account on your behalf. You agree that you will not use any other person’s TREATABLE account. You agree to keep your information in your TREATABLE account accurate on an ongoing basis and your password private and, as a security measure, that you will exit your account after completing any use of TREATABLE. You agree that you will immediately notify TREATABLE about any unauthorized use of your account or breach of security that you know about by email to support@treatable.org.

COPYRIGHT, USE OF CONTENT and LIABILITY

The content on TREATABLE is protected by the copyright laws of the United States and other countries. TREATABLE allows you to observe and/or download a single copy of its content for your personal and non-commercial use only. If you observe and/or download content for any other purpose, you are in violation of these Terms and Conditions and you may be in violation of the law regarding copyright, trademark and/or other laws. You agree that TREATABLE may change or terminate content at any time without notice. TREATABLE makes no representations and/or warranties about the reliability, currency or accuracy of TREATABLE’s content.

TREATABLE makes no representations and/or warranties about compliance with government disclosure regulations on prescription drugs or government software regulation compliance. TREATABLE is not responsible for the actions of third parties who may transmit content. Content is provided “as is” and to the fullest extent the law allows, TREATABLE disclaims any and all warranties, express or implied, statutory or non-statutory, including, but not limited to the warranty of merchantability, warranty of fitness for a particular purpose, or any other warranty.

You agree that Treatable shall not be liable to you for claims for damages because of your use or misuse of content, or ability or inability to access content, including but not limited to claims for personal injury, negligence, wrongful death, lost profits or business interruption based on any legal theory. To the extent the law permits claims for damages to be limited, you agree any claim you make shall be limited to $500.00 or less, and agree to make such claim within one year of the event giving rise to such claim. You agree that the remedies provided in these Terms of Use are the exclusive remedies you have for any claims, if any at all, you might have against TREATABLE.

You agree to use TREATABLE only for the purpose it is intended, to facilitate the provision of non-medical services to you and third party medical care providers, labs, pharmacies and vendors. You agree you will not use TREATABLE for any other purpose or for an illegal purpose. You agree that you will only use TREATABLE pursuant and in compliance with all applicable federal, state and local laws. In the event TREATABLE suspects you are using TREATABLE for any other purpose, TREATABLE reserves the right to suspend your account. TREATABLE reserves the right to cooperate with any federal, state or local law enforcement agency to investigate any suspected use of TREATABLE other than to facilitate the provision of non-medical services to you and third party medical care providers, labs, pharmacies and vendors.

THIRD PARTIES

You agree that TREATABLE facilitates your use of third party medical care providers, labs, pharmacies and vendors. You agree that you will not hold TREATABLE liable or responsible for any damages as a result of your use of third party medical care providers, labs, pharmacies and vendors. You agree that TREATABLE is under no obligation to resolve or attempt to resolve any dispute or claim you may have with any third party medical care providers, labs, pharmacies and vendors facilitated by TREATABLE. You hereby release TREATABLE from any liability for any dispute or claim you may have with any third party medical care provider, lab, pharmacy and vendor for which TREATABLE has facilitated the provision of such goods and/or services. NOTE: IF YOU ARE A CALIFORNIA RESIDENT, YOU HEREBY WAIVE CALIFORNIA CIVIL CODE SECTION 1542 IN CONNECTION WITH THE FOREGOING, WHICH STATES: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.”

TERMS OF SALE

The third party medical care providers, labs, pharmacies and vendors for which TREATABLE facilitates and provides non-medical services may not always be available. You will not be charged for any third party medical care provider, lab, pharmacy or vendor good or service that is not available. The prices of the medical care providers, labs, pharmacies and vendors for which TREATABLE facilitates and provides non-medical services are subject to change at any time. TREATABLE may change its prices for its non-medical services of facilitating medical care providers, labs, pharmacies and vendors for you at any time. You agree that you are responsible for any taxes, levies fees or other government imposed charges on the third party medical care providers, labs, pharmacies and vendors for which TREATABLE facilitates and on TREATABLE facilitation fees. Some states require us to collect taxes and some states do not. We will collect taxes in those states that require us to do so. The law in your state may require you to report and pay taxes directly to your state taxing authorities.

You agree to pay for TREATABLE facilitated third party medical care providers, labs, pharmacies and vendors and TREATABLE facilitation fees through the valid payment options offered on TREATABLE. You are representing to TREATABALE that you are authorized to use the payment method you provide for the medical care providers, labs, pharmacies and vendors that TREATABLE facilitates. You agree TREATABLE can use the card information you provide to pay for TREATABLE’s facilitation fees, platform and other fees. You agree that TREATABLE may obtain updated payment card information in the event your card expires. You agree that TREATABLE may provide the payment information you provide to third parties to enable payment to TREATABLE and the third party medical care providers, labs, pharmacies and vendors required to complete your transaction.

If your payment method is declined, TREATABLE will attempt to process your payment until the transaction is approved. TREATABLE is not responsible for any fees or charges your bank or card company may charge. If your bank or card issuer reverses any payment, you agree that you will pay TREATABLE such reversed charge and that TREATABLE may initiate and collect such charge using any legally available method including, but not limited to a debt collection agency and/or courts of competent jurisdiction.

TREATABLE contracts with the third party payment processing vendor Stripe for payment. You can access Stripe’s privacy policy and other policies on their website. Stripe.com and Stripe.com/us/privacy. You agree to pay shipping and handling charges shown at the time of your purchase and that any delivery time estimates are just that, estimates and that sometimes delivery may take longer than estimated.

TREATABLE does not issue refunds after the provider has approved your lab requests or completed your consult.

TERMINATION

TREATABLE may terminate its services and/or part of its facilitation services, medical care providers, labs, pharmacies and vendors at any time without notice. TREATABLE may terminate your account with TREATABLE at any time. You agree that this agreement including, but not limited to, the provisions of these Terms of Use that prohibit certain activities on your behalf, copyright protections, limitation of liability, arbitration, waiver of rights all continue to remain in force even if TREATABLE has terminated your account. You agree that TREABABLE has no obligation to provide you with any content or information, including but not limited to information you provided to TREATABLE, after the termination of your account.

ARBITRATION

You agree to submit to binding, individual confidential arbitration for claims and/or disputes, if any, you may have between you and TREATABLE or the medical providers, labs, pharmacies and vendors facilitated by TREATABLE before one commercial arbitrator from the American Arbitration Association and that payment for such arbitrator will be according to the current American Arbitration Association fee schedule. You agree to waive your right to a jury trial, to participate in a class action lawsuit or class wide arbitration for any such claim or dispute. You acknowledge that you are voluntarily and knowingly waiving your right to a jury trial in federal and/or state court. Unless prohibited by law, you agree that you will pay your own attorneys’ fees and expenses as a result of any arbitration. The award of the arbitrator shall be final and binding and may be entered into a court of law as a final judgment.

Prior to seeking arbitration for any claim or dispute pursuant to these Terms of Use, you agree to first attempt to resolve such claim or dispute by sending written notice to TREATABLE at SEOHUB, LLC, d/b/a SEOHUB, LLC d/b/a Treatable.org, P.O. Box 457, Media, PA 19063, AATN: Dispute Department. Written notice shall include your name, the address of your residence, your account user name, your email address and a detailed explanation of your dispute or claim. We agree that we will make a good faith effort to resolve your dispute or claim within 30 days of receiving your written notice of your dispute or claim. If a dispute or claim remains unresolved after 30 days of us receiving your dispute or claim as detailed above, either party may then, and only then, initiate arbitration as described above.

Arbitration shall take place within 100 miles of Media, Pennsylvania, or, if Media, Pennsylvania is more than 100 miles from your residence, within 100 miles of your residence, or upon agreement, in another place.

Exception to Arbitration. If any claim arises pursuant to the Computer Fraud and Abuse Act, or is a claim grounded in violation of intellectual property rights, theft, piracy or unauthorized use of TREATABLE, you agree that TREATABLE, and/or the medical providers, labs, pharmacies and vendors whose goods and services are facilitated by TREATABLE may seek injunctive relief in a state or federal court in Delaware County, Pennsylvania and/or Philadelphia, Pennsylvania. You agree to submit to the personal jurisdiction of the Delaware County Court of Common Pleas and/or the United States District Court for the Eastern District of Pennsylvania.

You may opt out of arbitration for claims and/or disputes by sending written notice to SEOHUB, LLC d/b/a Treatable.org, P.O. Box 457, Media, PA 19063 within 30 days of your first agreement to these Terms of Use with TREATABLE in which you agree to arbitration. If you fail to notify us in writing as prescribed within 30 days of your first agreement to these Terms of Use with TREATABLE in which you agree to arbitration, you agree that you have waived your right to opt out of arbitration.

APPLICABLE LAW/SEVERABILITY

TREATABLE is operated by SEOHUB, LLC which is a Pennsylvania Limited Liability Company with its principal offices in Media, PA. These Terms of Use are governed the laws of Pennsylvania and the Federal Arbitration Act. You agree that you will not use TREATABLE if you reside in a jurisdiction in which the use of TREATABLE is not legal. You agree to ensure that your use of TREATABLE complies with the laws of the jurisdictions in which you reside or the jurisdictions from which you use TREATABLE. In the event any of the provisions of this agreement are found to be unenforceable, the remaining provisions continue to be enforceable and the invalidated section(s), if any, shall be interpreted to be enforceable as nearly the intent of the Terms of Use language permits in accordance with federal, state and local law. Our failure, if any, to enforce any provision in these Terms of Use shall not be construed of a waiver of that or those provisions.

MISCELLANEOUS

You may not assign any rights you have under these terms of Use. You agree that TREATABLE may assign its rights and/or obligations under this agreement to third parties if doing so is for the purpose of a merger or acquisition of TREATABLE or any portion of TREATABLE’s business operations. You agree that these Terms of Use and/or the use of TREATBALE does not create an agency relationship between you and TREATABLE. You agree that these Terms of Use and the use of TREATABLE does not create any third party rights and that no third party may enforce any right created, to the extent any rights actually exist, between you and TREATABLE. It is our desire to serve you by providing non-medical services that facilitate your medical care from medical providers, labs, pharmacies and vendors. These Terms of Use are necessary for us to be able to provide you with these non-medical services.
